'This is an assault on the judiciary' - NPP’s Frank Davies criticises Chief Justice suspension

Frank Davies, the NPP’s Director of Legal Affairs, criticized the suspension of the Chief Justice. He called it a “direct assault on the judiciary.” He warned that this could harm the integrity of democratic institutions.

Davies spoke on PM Express on Joy News. He expressed concern over President John Mahama’s decision to suspend Gertrude Araba Sackey Esaaba Torkornoo. The President also formed a five-member committee to investigate her removal.

“This is unprecedented in our democracy,” he said. “It’s the first time a Chief Justice has been suspended for removal petitions.”

He acknowledged that the process is constitutionally allowed under Article 146. However, he emphasized that it still feels like an attack on the judiciary.

Davies pointed out troubling commentary from senior political figures. Their statements suggest that there is a desire to remove this Chief Justice.

He noted that starting a removal process must be considered carefully. “This isn’t just about legal procedures; it’s about perception,” he said.

“If the head of the judiciary can be treated this way, what about others?” he asked.

On Monday, President Mahama announced a five-member committee for investigation. This panel includes experts from legal, academic, military, and public service backgrounds. They are tasked with conducting an independent inquiry.

However, Davies questioned the atmosphere surrounding this process. “This is about our Chief Justice,” he stated. “Fairness and impartiality are crucial.”

While he did not doubt the legal basis for the inquiry, he highlighted its political context. “There’s a difference between following the Constitution and weaponizing it,” he cautioned.

Davies urged Ghanaians to protect judicial independence. “If today it’s the Chief Justice, tomorrow it could be any judge,” he warned. “That’s a slippery slope.”
