The Supreme Court has dismissed an objection from the Attorney General. This objection sought to remove Justice Scott Pwamang, Justice Adibu-Asiedu, and other committee members. They are investigating the potential removal of Chief Justice Gertrude Torkonoo.
Chief Justice Torkonoo is currently suspended. She is in court with her husband. They are seeking an injunction to stop the committee's proceedings. This committee is led by Justice Pwamang.
The injunction is part of a larger suit for constitutional interpretation. Torkonoo requests several things from the court:
1. To waive her right to a private hearing,
2. To declare the committee's determination unconstitutional,
3. To bar committee members from continuing their work.
Deputy Attorney General Dr. Justice Srem-Sai represented the state in court. He argued that the writ did not name committee members as defendants. Therefore, he asked for their removal from the case.
Former Attorney General Godfred Yeboah Dame opposed this objection. He argued that reliefs were being sought against these individuals. The Supreme Court panel agreed with Dame’s position.
A five-member panel, led by Acting Chief Justice Paul Baffoe-Bonnie, ruled in favor of Dame. As a result, the committee members will remain as parties in the case while proceedings continue.
