Prof. Stephen Kwaku Asare has petitioned President Nana Addo Dankwa Akufo-Addo to initiate the removal of Chief Justice Gertrude Torkornoo, citing alleged misbehavior and incompetence in her administrative role.
The petition, dated December 17, is based on Article 146 (1) of the 1992 Constitution, which allows for the removal of a Superior Court Justice for stated misbehavior, incompetence, or inability to perform due to infirmity.
Prof. Asare clarified that his petition does not challenge the Chief Justice's judicial rulings but focuses on her administrative actions.
He alleged that she undermines the constitutional process by orchestrating judicial appointments and influencing the reconstitution of judicial panels without explanation, which he claims threatens judicial impartiality and independence.
The petitioner expects Judicial Council members to testify during the review process.
