Mustapha Seidu, Director of the Nature and Development Foundation, supports amending Legislative Instrument (L.I.) 2462. This law currently allows mining in Ghana's forest reserves. He cautioned that changes must ensure full protection of these resources.
At the JoyNews National Dialogue on L.I. 2462, Mr. Seidu praised the government's plan. They aim to remove presidential powers for mining in Globally Significant Biodiversity Areas (GSBAs). He called this a significant and welcome development.
Mr. Seidu stated, “It is good for the President to take action.” However, he warned that stopping there could protect less than 10% of forest reserves.
He identified a core problem with Regulation 3 of L.I. 2462. It only specifies areas where mining is banned, leaving other areas open to mining.
He emphasized that mining should be an exception in forest reserves. He also noted potential legal issues from halting long-standing operations.
“Some companies have mined for decades,” he said. “Removing them could create contractual challenges.” However, he argued this shouldn't lead to unrestricted mining in all reserves.
Mr. Seidu acknowledged some positive aspects of L.I. 2462. He highlighted provisions for governance over mining revenue, including a clause for using 0.6% of proceeds for specific purposes.
“Before this law, funds were collected without a legal framework,” he explained. “That part is significant.”
Despite these positives, Mr. Seidu insisted on more comprehensive reforms. He urged amendments that prioritize environmental sustainability and prevent exploitation of Ghana’s forests.
