An assembly of lawyers should know better - Srem Sai questions GBA's legal reasoning

Deputy Attorney General Justice Srem Sai has raised concerns about the Ghana Bar Association (GBA).

His comments follow the GBA's recent resolution. This resolution calls for the withdrawal of the Acting Chief Justice’s directive. It also demands the reinstatement of the suspended Chief Justice.

On Joy News’ PM Express, Srem Sai criticized the GBA's position. He questioned its process, logic, and implications.

He noted that only 45 individuals passed this resolution. Yet, it represents an association of over 5,000 lawyers. He believes this lacks the expected legal rigor.

Srem Sai emphasized that law is not determined by democracy. He stated that popular opinion does not define legal meaning.

He reminded lawyers that law relies on sound reasoning and case law. The Constitution should guide legal interpretations.

The GBA’s resolution addressed a matter already decided by the Supreme Court. Srem Sai pointed out that there is already a ruling on this issue.

He expressed disbelief that lawyers would pass a resolution contradicting a Supreme Court decision.

Additionally, he was alarmed by the GBA's call for public disclosure of certain details. The Constitution prohibits making such information public.

Srem Sai highlighted that three decisions confirm this constitutional requirement. The petition and related proceedings must remain confidential.

He stressed that if lawyers support making private matters public, it raises serious concerns about their understanding of the law.
