CJ Torkornoo’s posture after suspension is provocative and abusive of the Constitution – Dr Khalid

Professor Sharif Mahmud Khalid, Economic Adviser to the Vice President, has criticized suspended Chief Justice Gertrude Torkornoo. He described her actions since her suspension as provocative and unconstitutional.

On Saturday, May 24, Dr. Khalid spoke on JoyNews’ Newsfile programme. He questioned her public behavior during the ongoing constitutional process against her.

He stated, “Her posturing as a suspended Chief Justice provokes the Judiciary.” He added that it is an abuse of the 1992 Constitution.

Dr. Khalid expressed concern about her understanding of constitutional procedures. He believes she should know the limits of her actions during such proceedings.

He pointed out that the constitution outlines a clear process for these matters. This includes a requirement for proceedings to be held in-camera.

“It is explicit in the constitution that processes should be in-camera,” he said. He suggested that her request for public proceedings contradicts these provisions.

Dr. Khalid also noted that once a petition reaches the Council of State, the process becomes automatic. There is no room for presidential discretion or interference at this stage.

“It is explicit that the President has nothing to do with this process,” he added. “It must take an automatic course, and she knows it.”
