The Ghana Bar Association (GBA) has criticized President John Mahama's suspension of Chief Justice Gertrude Torkornoo.
The GBA's statement, signed by President Efua Ghartey, calls for an immediate revocation. They label the suspension an "unconstitutional act." This is due to a lack of published regulations governing such executive actions.
During its Mid-Year Conference in Accra, the GBA passed resolutions declaring the suspension flawed. They stated that the President used discretionary powers without required regulations. This omission makes the suspension unlawful, according to their April 26 statement.
On April 22, President Mahama suspended the Chief Justice. This followed the establishment of a committee to investigate petitions against her. The Presidency announced this move as compliant with constitutional provisions after consulting with the Council of State.
The GBA demands three immediate actions: revoke the suspension, create clear regulations for judicial discipline, and disclose evidence against the Chief Justice. They emphasized that "transparency cannot be sacrificed at the altar of expediency."
The GBA also noted that judicial independence relies on strict adherence to constitutional processes. Article 296 requires published rules for discretionary powers. Ignoring this provision could set a dangerous precedent for judicial accountability, they warned.
