Chief Justice's suspension is in her own interest - Law professor

Law lecturer Prof. Kwadwo Appiagyei-Atua has advised Chief Justice Gertrude Torkonoo to accept her suspension by President John Mahama in good faith.

Today, the President asked the Chief Justice to step aside. This decision follows sufficient grounds for a probe into three petitions seeking her removal.

The announcement was made in a release signed by Felix Kwakye Ofosu, the President's Spokesperson and Minister for Government Communication.

According to Article 146 (10) of the Constitution, President Mahama suspended the Chief Justice immediately. This action was taken upon advice from the Council of State and pending committee proceedings.

President Mahama also appointed a five-member committee to investigate the matter. This committee will determine the fate of the Chief Justice.

Prof. Appiagyei-Atua commented on this situation. He believes that if the Chief Justice remains in office, it could hinder the committee's work.

He stated that her presence might create bias during investigations. Additionally, performing her duties as Chief Justice could affect her ability to function before the committee.

For these reasons, he suggested it would be wise for her to accept the suspension.

Professor Appiagyei-Atua disagreed with claims that President Mahama made an error with his suspension order. He argued that it was a necessary step according to constitutional processes.

He emphasized that following constitutional procedures is crucial. The suspension of the Chief Justice is at the president's discretion under Article 146 (10).

He concluded that what President Mahama did is not unconstitutional or illegal. Therefore, it is within his rights to proceed with this process.
