Chief Justice removal process: GBA urges respect for Rule of Law

The Ghana Bar Association (GBA) has called for adherence to constitutional procedures. This response comes amid the ongoing process to remove Chief Justice Gertrude Torkornoo.

On April 24, GBA National President Mrs. Efua Ghartey and National Secretary Mr. Kwaku Gyau Baffour issued a statement. They noted that the GBA has been monitoring developments over the past two months. This includes the recent suspension of the Chief Justice by President John Mahama.

The GBA emphasized its commitment to defending freedom, justice, and judicial independence. The statement highlighted that the GBA focuses on matters affecting the legal profession.

As of March 27, 2025, three petitions have been submitted for the Chief Justice's removal. Additionally, two legal actions challenge the constitutionality of this process in the Supreme Court.

The Association cited Article 146 (6) to (10) of the 1992 Constitution. It acknowledged that the President can appoint a committee to investigate these petitions. The committee may suspend the Chief Justice pending its findings. The GBA stressed that this process is legally grounded and must be held in camera as required by law.

The GBA recognizes constitutional procedures for removing a Chief Justice. However, it also noted that this matter is currently sub judice. The Association hopes all involved will adhere to principles of Rule of Law.

Furthermore, the GBA reminded everyone to follow Article 296 of the Constitution. This article calls for fair and non-arbitrary discretion in decision-making.

“Justice comes from the people of Ghana,” stated the GBA. It emphasized that justice is administered by a Judiciary led by the Chief Justice. The GBA urged actions that build public confidence in the justice system.

Finally, it reaffirmed its role as "the conscience of society." The GBA aims to safeguard Rule of Law and uphold Ghana's Constitution, reflecting citizens' wishes and aspirations.
