Court of Appeal dismisses NAM1’s application to halt criminal trial

The Court of Appeal has dismissed an application from Nana Appiah Mensah. He is the CEO of the defunct Menzgold Ghana Limited, known as NAM1. The application aimed to stop his ongoing criminal trial.

This application was filed while he appealed a High Court ruling. The High Court had ordered him to open his defense in 2024. He faces multiple charges, including selling gold without a license and money laundering.

His legal team appealed the High Court’s decision. They also requested to pause proceedings at the High Court until the appeal was resolved.

On May 19, 2025, state prosecutors urged the appellate court to dismiss this application. They argued it overstepped court powers and lacked exceptional circumstances for a stay.

A three-member panel of the Court of Appeal reviewed the case. Justice Gbiel Suurbaareh led the panel, supported by Justices Afia Serwaa Asare-Botwe and Christopher Archer. They unanimously dismissed Nana Appiah Mensah's application.

Frederick Forson represents Menzgold's aggrieved customers. He welcomed the court’s decision as a step toward justice. Meanwhile, Nana Appiah Mensah is considering appealing to the Supreme Court based on his lawyer's advice.
