The Court of Appeal in Koforidua has granted an injunction. This was requested by Professor Margaret Kweku and others from the SALL traditional areas. They sought to restrain John Peter Amewu, the former MP for Hohoe.
The court has prohibited Mr. Amewu from claiming he is a former MP for Hohoe Constituency. This applies to his time in the 8th Parliament of the Fourth Republic.
Additionally, the court has stopped the Speaker of Parliament from processing or paying any entitlements to Mr. Amewu. This will remain in effect until the appeal is heard and decided.
On July 29, 2024, Justice Owoahene Acheampong dismissed an election petition against Mr. Amewu. The High Court ruled it lacked jurisdiction over the case.
A Notice of Appeal was filed on July 31, 2024, challenging this decision. The application for an interlocutory injunction was submitted on December 23, 2024, at the Court of Appeal.
Mr. Tsatsu Tsikata represented the petitioners during this application. He urged the court to prevent any payments to Mr. Amewu until after the appeal is resolved.
Counsel for Mr. Amewu argued that his client did nothing wrong. He suggested that any misleading information came from the Electoral Commission.
The three-member panel included Justice Bright Mensah, Justice Noble Nkrumah, and Justice Hasata Amaleboba. They found that the application had merit and granted it accordingly.
