Deputy Attorney General Dr. Justice Srem-Sai has condemned the misuse of parliamentary immunity. He warned that steps will be taken to prevent this abuse.
Dr. Srem-Sai emphasized that protections for Members of Parliament (MPs) aim to encourage responsible debate. They are not meant to shield individuals from accountability for false or defamatory remarks.
In a Facebook post, he expressed concerns about MPs using their immunity for baseless accusations. He stated that this constitutional provision should promote good-faith discussions, not misinformation.
“The Constitution grants MPs protection against defamation suits,” he said. “This protection aims to enhance quality parliamentary debate, not secure false commentary.”
Dr. Srem-Sai pointed out that one MP had misused this privilege by making misleading statements in Parliament. This behavior led to public discontent toward certain individuals.
He noted that such actions damage the integrity of parliamentary immunity. “An MP has abused this protection by spreading malicious falsehoods,” he added.
This misuse creates public disaffection and undermines the purpose of constitutional protection.
The Deputy Attorney General also addressed allegations regarding former Bank of Ghana Governor Dr. Ernest Addison. He stated that Dr. Addison was treated fairly during a National Security search at his home.
Dr. Srem-Sai clarified that Dr. Addison had legal representation throughout the process. The search was conducted professionally and within court authorization.
“Dr. Addison had access to legal counsel during the search,” he explained, adding it was done cordially and legally.
He reaffirmed the government’s commitment to addressing any abuse of parliamentary privileges. Necessary measures will be implemented to prevent exploitation of MPs’ constitutional protections.
“Such abuse will be corrected for the healthy growth of our democracy,” he concluded.
