The District Court in Enchi, Western North Region, has reversed its earlier ruling on illegal mining equipment. The court cited a lack of jurisdiction over galamsey-related cases. This decision was announced on April 2, 2025.
His Worship Lawrence Buenor Buer presided over the case. Six individuals were accused of illegal mining activities in the Boin Forest Reserve. Previously, the court ordered the release of two Liugong excavators and other equipment to their owners.
Upon review, the magistrate found that this decision was "wrong in law." His Worship Buenor Buer stated that the District Court lacks jurisdiction to make such orders regarding illegal mining activities.
Using its inherent powers, the court declared the earlier order void. It directed that the excavators and equipment be retrieved by authorities. These items will be placed in custody of the Forestry Commission in Enchi.
The court also ordered the Enchi Police Command and Forestry Commission to recover the equipment from miners. They must secure it until a proper forum with jurisdiction resolves the matter.
Legal precedents like Moshie v. Begyina and Attoh Quarshie v. Okpoti were cited to support this authority. This development highlights challenges in addressing illegal mining in Ghana.
