Ex-Deputy AG questions validity of Council of State’s prima facie case against Chief Justice

Former Deputy Attorney-General Diana Asonaba Dapaah has raised concerns. She disagrees with the Council of State's decision. The Council established a prima facie case against Chief Justice Gertrude Torkornoo.

Dapaah's comments follow leaked documents from Daniel Ofori, Ayamga Akolgo, and Shining Stars of Ghana. This trio reportedly petitioned President John Mahama to remove the Chief Justice.

On Channel One TV, Dapaah discussed parts of the petitions. They accuse the Chief Justice of breaching natural justice in a recent Supreme Court ruling. She believes the Council's reasoning for proceeding is flawed.

Dapaah expressed concern about the allegations and their logic. She questioned how a petition based on a Supreme Court decision could lead to this determination. "I feel troubled for the other judges who sat on the panel," she said.

She also doubted the credibility of a police officer's petition who is also a lawyer. Dapaah criticized the evidence used in that petition as unorthodox.

“His evidence comes from a news platform called Law Platform,” she noted. “He claims that the CJ caused his arrest.”

In conclusion, Ms Dapaah rejected the Council’s findings entirely. She described their process as legally unsound and unconstitutional. “I have no doubt that finding a prima facie case was wrong,” she asserted.
