Ghana Bar Association attempting to circumvent the constitution – Deputy AG

Justice Srem Sai, the Deputy Attorney General and Minister of Justice, has made a statement. He claims the Ghana Bar Association (GBA) is trying to bypass the constitution.

The GBA has demanded that President John Dramani Mahama revoke Chief Justice Gertrude Torkornoo's suspension. They argue that this suspension is unconstitutional. They believe it lacks legal support under Ghana’s 1992 Constitution.

In a statement dated April 26, the GBA called for an immediate revocation of the suspension. They consider it unconstitutional because it was done without proper regulations. This action breaches Article 296 of the Constitution.

The GBA also asked President Mahama to release the full decision regarding Chief Justice Torkornoo's case. Justice Srem Sai stated that the GBA does not need law school to understand constitutional matters.

He pointed out that court decisions confirm this process should remain private. Speaking on TV3, he questioned why lawyers would want to make private matters public. He suggested this indicates an attempt to undermine the constitution.

Saviour Kudze, PRO of the GBA, spoke with Eyewitness News on April 29. He emphasized that regulations should exist before exercising such presidential discretion. He believes these regulations prevent abuse of power and criticized the president for not following this protocol.
