Ghana Bar Association calls for revocation of Chief Justice suspension, action on galamsey, others

The Ghana Bar Association (GBA) held its 2025 Mid-Year Conference at the Labadi Beach Hotel in Accra on April 26. They issued strong resolutions addressing key concerns in the legal profession and national governance.

One major resolution called for the immediate revocation of the Chief Justice's suspension. The GBA deemed this suspension unconstitutional. They argued that the President acted without necessary regulations under Article 296 of the 1992 Constitution.

The GBA urged for comprehensive regulations to govern proceedings under Article 146. This is especially important for removing or impeaching Superior Court judges. They also requested that the President release the full decision establishing a prima facie case against the Chief Justice. Transparency and adherence to established precedent are crucial.

Additionally, the GBA condemned politically motivated commentary aimed at undermining judicial independence. They vowed to protect the integrity of the judicial system from undue interference.

Regarding legal profession matters, the GBA called for withdrawing a directive from the Acting Chief Justice about court assignments and case dates. This directive created uncertainty. The GBA recommended using technology to manage case assignments better.

The Association also addressed illegal mining, known as galamsey. They condemned environmental destruction caused by galamsey activities and called for immediate government action. The GBA urged expedited hearings of galamsey-related cases to ensure offenders face justice.

On the Bawku conflict, they expressed concern over ongoing violence affecting lives and property. The GBA commended mediation efforts led by Otumfuo Osei Tutu II, Asantehene. They called on all parties to support and respect mediation outcomes.

The Association pledged to advocate for peace in Bawku and support legal measures needed for stability there.

Lastly, they addressed unresolved parliamentary elections in Ablekuma North Constituency. Despite residents voting on December 7, 2024, no MP has been declared yet. The GBA urged the Electoral Commission and police to complete this process to uphold democratic rights.

These resolutions reaffirmed the Ghana Bar Association's commitment to upholding rule of law, ensuring judicial independence, and contributing to national development through legal advocacy.
