Justice Abdulai, a private lawyer and member of the Ghana Bar Association, supports President John Dramani Mahama's suspension of Chief Justice Gertrude Torkornoo. He believes the suspension is constitutional and procedurally correct.
His support comes after the Ghana Bar Association (GBA) called the suspension unlawful. The GBA urged for an immediate reversal of the decision.
On Channel One TV, Justice Abdulai criticized the GBA’s resolution. He stated it lacks legal merit and disagreed with every part of it. He emphasized that both the President and the Council of State acted within their constitutional rights.
He explained that they considered all relevant information when assessing if a prima facie case existed. Justice Abdulai noted that typically, a Chief Justice's response should not influence this determination.
However, in this case, he said the President accepted advances made by the Chief Justice. This indicates that both the Council of State and the President factored in her response before concluding there was a prima facie case.
Justice Abdulai reaffirmed his belief in the legality of this process. He argued that the suspension was not arbitrary or capricious. Instead, it followed thorough constitutional procedures to maintain Ghana’s judicial integrity.
