KATH lawyer under fire for failing to defend hospital in battle with Director of Finance

Shocking details from the High Court in Kumasi reveal a serious legal mistake. This blunder involves Komfo Anokye Teaching Hospital’s (KATH) legal representative. It has allowed Mr. Elvis Kusi, the hospital's Director of Finance, to stay in office beyond his reappointment period.

Court documents show that Mr. Kusi was reappointed on December 20, 2021. His term was set to end on June 30, 2024. However, he filed a lawsuit against KATH on May 19, 2024—just weeks before his term expired. In this suit, he claimed that his original appointment from May 6, 2010, had not been revoked and still stands.

The KATH Board, led by Nana Effah-Apenteng, directed then-CEO Prof. Otchere Addai-Mensah to respond to Mr. Kusi’s motion for an injunction. They instructed the hospital’s lawyer, Nana Fredua Agyeman Osborn, to file a defense against it. Surprisingly, Mr. Osborn did not file any affidavit opposing the injunction.

On June 24, 2024, Mr. Osborn appeared in court and stated he had no opposition to the injunction against KATH. This declaration shocked the presiding judge and other lawyers present at the hearing. Despite this unexpected stance, the court granted the injunction against KATH.

Insiders claim that Prof. Addai-Mensah tried to protect both Mr. Kusi and Mr. Osborn from accountability for their actions. Allegedly, when the board wanted to meet about this issue, the CEO blocked it from being added to the agenda.

As it stands now, Mr. Elvis Kusi remains as Director of Finance at KATH without a valid appointment letter after his reappointment expired—a situation many consider legally untenable.

With a new board now in place at KATH, attention is focused on how they will address this legal issue and restore order within management. Stakeholders are urging immediate action to investigate and hold management accountable for these lapses.
