The Manhyia South MP, Nana Agyei Baffour Awuah, has raised concerns. He believes the Office of the Special Prosecutor (OSP) is allowing former Finance Minister Ken Ofori-Atta to control the investigation.
Speaking on PM Express on Joy News, he urged the OSP to reassess its strategy. He feels that the current approach relies too much on Ken's cooperation. This dependence gives control to those under investigation.
Baffour Awuah bluntly stated, “It seems that Ken and his lawyers have been dictating the pace.” He emphasized that the OSP is an investigative body and should not be outmaneuvered.
He noted that sometimes investigating bodies appear passive. They may pretend to tag along without showing authority. “Before you realize, they’ve hanged you on a gallows,” he warned.
The MP insisted that the OSP should not follow those being investigated. “Even if you want to arrest him, bait him,” he advised. He referenced a Twi proverb about letting dishonest people take the lead in a race.
Baffour Awuah pointed out that the law provides tools for action without needing Ken’s presence. According to Act 30, they can proceed without his arrest or presence.
He questioned why the OSP seems stuck in its investigation. If Ken's presence is necessary for a prima facie case, then their case appears weak. It suggests they cannot move forward without his input.
He reminded everyone of Ken's constitutional right not to incriminate himself. “Don’t forget, Ken has a right to remain silent,” he said. What happens if they arrest him and he refuses to talk?
Baffour Awuah believes the OSP’s tactics need revision. “I think the approach ought to vary,” he stated clearly. The current path may not serve public interest effectively.
To him, allowing suspects to set rules poses a real danger for investigations.
