Kwabena Agyei Agyapong, former General Secretary of the NPP, has challenged the Office of the Special Prosecutor (OSP). He disagrees with their declaration that former Finance Minister Ken Ofori-Atta is a fugitive.
In an interview with Citi FM on June 3, 2025, Mr. Agyapong stated that only courts can make such declarations. He said, "You are not a judge to declare someone a fugitive."
His comments followed an announcement by Special Prosecutor Kissi Agyebeng. The prosecutor claimed Mr. Ofori-Atta is a fugitive for not returning to Ghana and not cooperating with investigations.
Mr. Agyapong stressed the need for due process in accountability. He questioned, "What happens to the law that says you are innocent until proven guilty?"
The OSP defended its position. They stated Mr. Ofori-Atta did not provide enough evidence about his health issues and failed to cooperate in the case against him. As a result, he has been reinstated on their list of wanted individuals.
