Legal practitioner raises concerns over Chief Justice’s vulnerability to political influence

Kwame Adofo, a private legal practitioner, has raised concerns about Ghana's constitution. He believes the framework for removing a Chief Justice has flaws.

On Asaase Radio's The Forum, he said the system makes the judiciary head vulnerable to politics. He noted that making a prima facie case is left to judges, specifically the Chief Justice.

However, he pointed out that the President ultimately decides on the Chief Justice's removal. This situation is dangerous, according to Adofo.

He highlighted a difference in how the Constitution treats judges' removal. For ordinary Superior Court judges, three Justices are needed for a committee. But only two Justices are required for a Chief Justice.

Adofo questioned whether this was intentional and warned of potential instability in the position. He suggested political shifts could lead to frequent changes in Chief Justices.

“Every four years, we may have to change a Chief Justice,” he said. Judges might feel pressured to seek political favors as a result.

He also expressed concern that political interests could influence judicial appointments. “Anyone who wins will likely have their own Chief Justice in mind,” he stated.
