Mahama risks violating oath by accepting resignation of suspended CJ – Martin Amidu Warns

Former Special Prosecutor Martin Amidu has warned President John Dramani Mahama. He stated that accepting the resignation of a suspended Supreme Court judge would breach constitutional duties.

In an opinion piece shared with MyNewsGH, Amidu stressed the importance of allowing Article 146 proceedings to proceed. He urged the president not to accept any resignation that could interfere with the committee's findings.

Amidu cautioned that accepting such a resignation would violate the Presidential Oath. This is especially true if a prima facie case for removal exists against the justice under investigation.

He explained that this action could undermine judicial accountability and raise questions about the president’s impartiality. Accepting a resignation during ongoing hearings might suggest presidential influence over the petition process.

Amidu noted that this case is already well-known to the public. A committee has been formed to investigate three petitions against a suspended Supreme Court justice.

He expressed concern over leaked documents related to this case. Both petitions and responses have circulated in media without official release from the presidency.

Amidu criticized these leaks as unconstitutional, stating they aim to influence public opinion and pressure the justice into resigning. He believes this undermines due process and accountability within the judiciary.

The leaks have sparked media campaigns urging the justice to resign, which could avoid necessary scrutiny. This situation raises serious concerns about fairness and integrity in judicial processes.
