Not every dispute needs to be litigated – Chief Justice

In a recent address, Chief Justice Kwasi Anin-Yeboah emphasized that not all disputes require court intervention and litigation. Speaking at the opening of the new legal year, he urged individuals to consider alternative dispute resolution methods, such as mediation and arbitration, before resorting to legal battles. The Chief Justice highlighted that litigation can be time-consuming and costly for all parties involved. He encouraged judges to promote amicable resolutions within their courts, fostering a culture where disputes are settled outside traditional courtroom settings. This approach not only alleviates the burden on the judiciary but also allows for faster resolutions that are often more satisfactory for those involved. Anin-Yeboah's remarks come in light of increasing caseloads in Ghana’s judicial system, underscoring the need for efficiency in resolving conflicts. He reiterated the importance of understanding the nature of disputes and exploring less adversarial avenues to achieve justice. By prioritizing these alternatives, he believes society can benefit from a more harmonious resolution process while preserving judicial resources for cases that truly require formal legal proceedings.
