Ofori-Atta diagnosed with cancer, Special Prosecutor reveals

Former Finance Minister Ken Ofori-Atta is wanted again. The Office of the Special Prosecutor (OSP) declared him so after he missed questioning on June 2, 2025.

At a news conference in Accra, Special Prosecutor Kissi Agyebeng spoke about Mr. Ofori-Atta's situation. His lawyers claimed he has cancer. However, Mr. Agyebeng questioned the credibility of this excuse.

Timeline of Evasion

Mr. Ofori-Atta was first labeled a "fugitive from justice" in February 2025. He failed to respond to multiple invitations from the OSP regarding corruption investigations. These include:

- His involvement in a revenue assurance contract with Strategic Mobilisation Ghana Limited (SML).
- Financial dealings for the National Cathedral's construction.
- Various procurement and expenditure issues during his term from 2017 to 2024.

He was removed from the wanted list on February 18, 2025, after assurances from his legal team that he would return on June 2. That date has now passed without his appearance.

Cancer Diagnosis Cited

Special Prosecutor Agyebeng confirmed that Mr. Ofori-Atta’s lawyers submitted medical documents about his health. They cited an "unexpected deterioration" and a recent cancer diagnosis. The team requested that he give a caution statement virtually under the Electronic Transactions Act.

The OSP rejected this request, emphasizing the need for physical attendance for thorough investigation and accountability. “Legal representation cannot replace personal attendance,” Mr. Agyebeng stated.

INTERPOL Red Notice Looms

This situation has prompted renewed efforts by the OSP to locate Mr. Ofori-Atta. The office plans to initiate processes for an INTERPOL Red Notice, which would help arrest and extradite him internationally.

Legal Challenge Pending

Meanwhile, Mr. Ofori-Atta’s legal team is challenging the OSP in court. He filed a suit at the Human Rights Court against being declared wanted, claiming it violates his rights. He also seeks removal of related content from the OSP’s digital platforms.

The court is expected to rule on this matter on June 18, 2025.

High Stakes

This case is one of Ghana’s most closely watched legal battles. It tests the authority of the Office of the Special Prosecutor and accountability for high-ranking officials accused of corruption.

Mr. Agyebeng concluded with a strong message: “No one is above the law.” He affirmed that fighting corruption will not be compromised regardless of stakes involved.

Minutes into the news conference, the OSP published Mr. Ofori-Atta's image online and declared him wanted again.
