Patient sues hospital for having CCTV cameras in consulting room during breast examination

Gifty Amoakowaa has filed a lawsuit against Peace and Love Hospital. She challenges the installation of CCTV cameras in medical consultation and examination rooms. She claims this violates her fundamental rights.

In her notice to the High Court, she seeks enforcement of her human rights. These include her right to privacy, dignity, and confidentiality in the doctor-patient relationship.

Allegations of Rights Violation

Amoakowaa argues that surveillance cameras in sensitive examination rooms breach her privacy. This is against Articles 15 and 18(2) of Ghana's 1992 Constitution.

She also states that it violates the confidential nature of the doctor-patient relationship. This is protected under Section 167 and the Sixth Schedule of the Public Health Act, 2012 (Act 851).

The suit mentions psychological trauma and emotional distress caused by this intrusion. Amoakowaa describes it as an unjustifiable invasion into her private medical experiences.

Reliefs Sought

Amoakowaa requests several declarations and orders from the court:

1. A declaration that using CCTV in breast examination rooms is unlawful.

2. An order for immediate removal of all CCTV cameras from these rooms.

3. A directive for the hospital to delete any footage related to her.

4. General damages for psychological and emotional harm caused by this breach.

5. An award for legal costs associated with her application.

The notice states that she relies on grounds set out in an accompanying affidavit. She reserves the right to seek additional orders deemed just by the court.
