Petition for CJ’s removal shouldn't have been publicised – Sam Okudzeto

Sam Okudzeto, a former President of the Ghana Bar Association (GBA), has criticized the decision to publicize petitions against Chief Justice Gertrude Torkonoo.

He believes such matters should remain confidential until a prima facie case is established.

In an interview on Joy FM's Top Story, he expressed his concerns. He stated that making these petitions public early is flawed.

Okudzeto emphasized that this information should not have been shared publicly. During his time on the Council of State, he felt it was wrong to disclose such petitions when submitted to the President.

He noted that publicity should only follow if the Council and President find a prima facie case. He reiterated that this approach is incorrect.

His comments come after President Mahama began consultations with the Council of State. This follows three petitions calling for the Chief Justice's removal.

Felix Kwakye Ofosu, Minister for Government Communications, confirmed that these petitions were forwarded to the Council of State. This action aligns with Article 146 of the 1992 Constitution.

Additionally, two lawsuits have been filed at the Supreme Court regarding how these petitions are being handled. The Chief Justice has also written to the President requesting copies of the petitions seeking her removal.

When asked about legality if they proceed without her response, Okudzeto said it goes beyond legal issues.

He argued that common sense must prevail in this situation. He questioned how the Council and President can act without input from the accused person.

"They need her response to make an informed decision," he explained.
