President John Dramani Mahama has formed a five-member committee. This committee will investigate three petitions against Chief Justice Gertrude Araba Esaaba Sackey Torkornoo. The formation follows the establishment of a prima facie case.
The decision came after consultations with the Council of State. It aligns with Article 146(6) of the 1992 Constitution. The committee will look into allegations of misconduct, abuse of office, and constitutional breaches.
The committee members are:
- Justice Gabriel Scott Pwamang, Supreme Court – Chairman
- Justice Samuel Kwame Adibu-Asiedu, Supreme Court – Member
- Daniel Yaw Domelevo, Former Auditor-General – Member
- Major Flora Bazwaanura Dalugo, Ghana Armed Forces – Member
- Professor James Sefah Dzisah, University of Ghana – Member
This diverse group brings legal, academic, military, and accountability expertise. Analysts believe this shows how seriously the presidency is taking the issue. They also emphasize the need for a transparent and independent investigation.
Felix Kwakye Ofosu signed a statement on behalf of the President. He is the Minister for Government Communication. The statement confirms that forming this committee follows constitutional provisions to maintain public trust in the judiciary.
The petitions were filed by individuals including Prof. Stephen Kwaku Asare. They cite alleged irregularities like unauthorized reconstitution of Supreme Court panels and issuing practice directions without legal backing.
In line with Article 146(10) of the Constitution, the President has suspended the Chief Justice pending inquiry results. The committee is expected to start its work soon.
