Prof. Kwadwo Appiagyei-Atua, a law lecturer at the University of Ghana, has shared his views on recent events. He believes President John Mahama's actions regarding the Chief Justice are constitutional.
On April 22, President Mahama suspended Chief Justice Gertrude Torkornoo. This suspension came after a committee was formed to investigate petitions against her.
The presidency stated that this action follows constitutional provisions and consultations with the Council of State.
Prof. Appiagyei-Atua explained that the President acted within his rights. He emphasized that there has been no violation of any constitutional provisions.
During an appearance on JoyNews’ The Pulse Show, he stressed the importance of allowing due process to unfold. He said it is crucial not to interfere with the constitutionally mandated process.
He added, “If we allow the committee to do its work as laid down by the Constitution, then I think what the President has done is not against the Constitution.”
He reiterated that the President has not broken any laws and is within his rights.
However, he also highlighted the need for respect for due process. Premature conclusions could undermine Ghana’s democratic institutions.
“I think the process should be allowed to be followed,” he concluded.
