Former Attorney General Nii Ayikoi Otoo has called for a review of the President's role in appointing committees. These committees investigate petitions for the removal of the Chief Justice.
He spoke on JoyNews’ Newsfile on Saturday, March 29. Otoo emphasized the need for clarity in this process. This is especially important as Ghana undergoes a constitutional review.
Otoo noted that the current system gives the President too much discretion. This could impact the fairness of investigations into such petitions.
“When a prima facie case is established, a five-member committee is formed,” he explained. “This issue must be clarified.”
He raised concerns about executive influence, citing the Adjei Tsum case. The President can choose committee members, which raises questions about fairness.
According to the constitution, when a petition is filed against the Chief Justice, the President consults with the Council of State. Together, they appoint a committee consisting of two Supreme Court justices and three other individuals.
One Supreme Court justice serves as chairman, appointed by the President. The other members cannot be from Parliament or legal professions.
Mr. Otoo believes this process needs to be more transparent and free from executive control. He urged legal experts and stakeholders to address these issues during the ongoing constitutional review.
