The Ghana Bar Association (GBA) has called for the immediate revocation of Chief Justice Gertrude Torkornoo's suspension. They describe this action as unconstitutional and lacking legal basis under Ghana’s 1992 Constitution.
In a statement dated April 26, the GBA criticized the President's decision. They argued that suspending the Chief Justice under Article 146(10) is flawed. The suspension occurred without any published regulations or instruments, violating Article 296 of the Constitution.
“The Ghana Bar Association calls for the immediate revocation of the suspension,” their statement said. They believe this suspension is unconstitutional.
The GBA also urged the government to create clear regulations for Article 146. This article governs impeachment or removal of Superior Court justices. Without these regulations, transparency and fairness in judicial proceedings are compromised.
Additionally, the GBA requested that the President release details about the case against Chief Justice Torkornoo. They stated this would ensure procedural fairness and transparency.
The Bar Association condemned prejudicial comments surrounding this issue. They warned such statements could erode public trust in the judiciary.
“The Association affirms its commitment to protecting judicial integrity,” they added. They plan to take legal measures against undue interference or unjust attacks on the Judiciary.
