Special Prosecutor must clearly explain why Ofori-Atta must appear in person – Martin Kpebu

Private lawyer Martin Kpebu has urged the Office of the Special Prosecutor (OSP) to explain its insistence on former Finance Minister Ken Ofori-Atta's physical presence in legal proceedings.

On Joy FM’s News Night, Mr. Kpebu highlighted that the OSP has started extradition proceedings and an Interpol Red Notice against Mr. Ofori-Atta. However, he noted that the OSP has not explained why it won't consider a video conference. This is especially relevant given the Mutual Legal Assistance Act, 2010 (Act 807).

Mr. Kpebu said, "If you just say you insist he should come, articulate the reasons." He emphasized that if there is a law allowing video conferences, there must be clear reasons for ignoring it.

The former Finance Minister's legal team cited health issues as reasons for his absence. They mentioned a cancer diagnosis and upcoming surgery.

Mr. Ofori-Atta's lawyers suggested a virtual interview instead. However, Special Prosecutor Kissi Agyebeng rejected this proposal and insisted on his physical presence. After Mr. Ofori-Atta missed the June 2 deadline, he was declared wanted again.

The OSP stated that suspects in criminal investigations must appear in person. They believe legal representation or virtual interviews cannot replace physical attendance.

Additionally, the office has initiated an Interpol Red Notice to aid in Mr. Ofori-Atta's arrest and extradition.

Mr. Kpebu argued that if the Special Prosecutor plans to bypass established legal options like video testimony, they owe the public a clear justification for this choice.

Despite this, Mr. Kpebu expressed that he does not oppose the decision to declare Mr. Ofori-Atta wanted in principle.
