Supreme Court adjourns Chief Justice removal case over absence of key legal representatives

The Supreme Court has postponed the hearing on a case about the Chief Justice's removal. This decision was made on Tuesday, April 9, 2025. The adjournment occurred because the Attorney General, Dr. Dominic Ayine, and his deputy were absent. They requested a delay due to training for state attorneys.

The case involves Vincent Ekow Asafuah's petition. He argues that the President’s consultation with the Council of State is unconstitutional without first asking the Chief Justice for input. The Attorney General had asked to postpone all cases from April 7 to April 10 for this training workshop.

Two state attorneys sought an adjournment out of courtesy to the court. One of them was a former Personal Assistant to the Attorney General. However, Godfred Yeboah Dame, representing Asafuah, was surprised by their absence. He noted that the legal training was known in advance and questioned the timing of their request.

Dame emphasized that this case has significant constitutional implications and should proceed. He requested an adjournment until Monday, April 14. However, Justice Henrietta Mensah Bonsu ruled to adjourn indefinitely.

This case raises important questions about removing a sitting Chief Justice. It also examines whether the President must consult with the Chief Justice before involving the Council of State. The indefinite postponement means there is no new hearing date set yet.
