Supreme Court backs Mahama on CJ suspension, dismisses CenCES suit

The Supreme Court has ruled 4–1 against a case from CenCES. This group challenged President John Mahama’s suspension of Chief Justice Gertrude Torkornoo. They also sought to stop the inquiry into her possible removal.

The court's five-member panel was led by Justice Baffoe-Bonnie. They supported the presidency, allowing the investigative committee to continue its work. Justice Yaw Asare Darko was the only dissenting voice.

CenCES argued that the President’s actions violated judicial independence and due process. They claimed the case for suspending the Chief Justice was flawed and unconstitutional. It did not follow procedures in Article 146 of the Constitution.

CenCES filed their suit on May 15, 2025. They aimed to invalidate the suspension warrant and disband Justice Gabriel Pwamang's committee. The group also wanted to prevent the Chief Justice from participating due to a conflict of interest.

Despite strong arguments, the Supreme Court upheld the President’s authority. This decision allows investigative proceedings to move forward.

Additionally, a private citizen named Theodore Kofi Atta-Quartey has filed a second challenge. He seeks an injunction on the committee’s work until his case is resolved.
