Supreme Court dismisses Assafuah’s injunction application against CJ’s removal process

The Supreme Court has dismissed an application to stop the removal of Chief Justice Gertrude Torkornoo. The decision was made by a narrow 3-2 majority.

The application was filed by Vincent Ekow Assafuah, an MP for Old Tafo. His lawyer, Godfred Yeboah Dame, is a former Attorney General.

Acting Chief Justice Paul Baffoe-Bonnie and Justices Yonny Kulendi and Amadu Tanko ruled against the request. Justices Henrietta Mensah Bonsu and Ernest Gaewu disagreed with this decision.

The court will release full reasons for its ruling on May 21, 2025.

Chief Justice Torkornoo was suspended by President John Dramani Mahama on April 22. This followed a prima facie case established against her. The suspension was based on petitions from Daniel Ofori, Ayamga Akolgo, and Shining Stars of Ghana.

A five-member committee has been formed to investigate the allegations against her. Before the petition went to the Council of State, Assafuah sought an injunction at the Supreme Court. He aimed to prevent the president from sending the petition to Torkornoo for a response.
