Supreme Court dismisses injunction application against proceeding with petitions to remove CJ in 3–2 decision

The Supreme Court has dismissed an application for an injunction. This decision was made by a 3–2 majority. The case involves petitions to remove Chief Justice Gertrude Torkornoo.

Justices Henrietta Mensa Bonsu and Ernest Gaewu dissented from the majority. They believed the case should not proceed without delay.

The Court will release its full reasoning on May 21, 2025. The injunction application is part of a larger legal challenge. It raises important questions about due process and judicial independence.

The legal team opposing the suspension argued that proceeding could harm judicial integrity. They wanted preliminary questions resolved first.

However, the majority disagreed. They found no sufficient grounds to halt the case now.

This decision follows earlier drama regarding the panel's composition. Former Attorney General Godfred Yeboah Dame objected to Justice Paul Baffoe-Bonnie’s role in leading the panel. He claimed it was improper for an acting Chief Justice to preside over this matter.

The Court unanimously dismissed this objection after a brief recess. Proceedings continued under Justice Baffoe-Bonnie’s leadership.

The current panel includes Justices Paul Baffoe-Bonnie, Henrietta Mensa Bonsu, Yonny Kulendi, Amadu Tanko, and Ernest Gaewu.
