Supreme Court rejects AG’s bid to remove Justice Pwamang, others from Torkonoo case as defendants

The Supreme Court has dismissed an objection from the Attorney General. This objection sought to remove Justice Scott Pwamang, Justice Adibu-Asiedu, and other committee members. They are investigating the potential removal of Chief Justice Gertrude Torkonoo.

Chief Justice Torkonoo is currently suspended. She is in court with her husband. They are seeking an injunction to stop the committee's proceedings led by Justice Pwamang. This injunction is part of a larger suit for constitutional interpretation.

Torkonoo's filing includes several requests. She asks the court to allow her to waive her right to a private hearing. She also wants the court to declare the committee's determination unconstitutional. Lastly, she seeks to bar committee members from continuing their work.

Deputy Attorney General Dr. Justice Srem-Sai represented the state in court. He argued that the writ did not name committee members as affected parties. Therefore, he requested their removal as defendants.

Former Attorney General Godfred Yeboah Dame opposed this objection. He argued that reliefs were being sought against these individuals, including committee members.

A five-member Supreme Court panel ruled in favor of Dame’s position. The panel was chaired by Acting Chief Justice Paul Baffoe-Bonnie. As a result, the committee members will remain as parties in the case while proceedings continue.
