Supreme Court sets May 6 for hearing of injunction applications in Chief Justice Case

The Supreme Court has rescheduled the hearing of injunction applications challenging the petition for the removal of Chief Justice Gertrude Sackey Torkornoo to May 6, 2025.

A four-member panel, chaired by Justice Osei Bonsu, announced the new date on Wednesday, April 16, explaining that the adjournment was due to unavoidable reasons following the absence of the fifth panel member, Justice Samuel Asiedu.

During the previous hearing, former Attorney General Godfred Yeboah Dame, who is representing the Member of Parliament for Old Tafo—the plaintiff in one of the suits—argued that President Mahama must halt any consultation with the Council of State until the matter is decided by the court. He maintained that once an injunction application is filed, all related processes must be paused to avoid undermining judicial proceedings.

However, the current Attorney General, Dr Dominic Ayine, pushed back, saying that the President is acting within his constitutional mandate.

“He needs to understand that this is the performance of a constitutional duty, and the law is very clear—you cannot enjoin the performance of a constitutional or public obligation,” Dr Ayine said.

The legal standoff continues to draw public interest, highlighting tensions between constitutional authority and judicial oversight in Ghana’s governance framework.
