Supreme Court strikes out Torkornoo’s supplementary affidavit

The Supreme Court has dismissed a supplementary affidavit from suspended Chief Justice Gertrude Torkonoo. This affidavit supported her application for an injunction. It claimed inhumane treatment and violations of her dignity. Torkonoo described the ongoing proceedings as a "mockery of justice" and a "ruse" to remove her unjustly.

However, the court ruled that the affidavit referred to events before a committee. This committee is investigating petitions for her removal. By law, these proceedings must be held in private.

A five-member panel upheld an objection from Deputy Attorney General Justice Srem Sai. He argued that the affidavit violated Article 146(8) of the Constitution. This article requires that removal proceedings for justices be conducted confidentially.

The Deputy Attorney General stated that Torkonoo's affidavit disclosed details about the committee's discussions. He said this was a breach of constitutional requirements.

Former Attorney General Godfred Yeboah Dame represented Justice Torkonoo. He argued that the affidavit was submitted within a judicial forum and not made public. He claimed this did not violate Article 146(8).

Despite this argument, the Supreme Court found that the affidavit breached confidentiality provisions in the Constitution. Therefore, they struck it out completely.
