The Supreme Court of Ghana will hear an application today. The application is from Theodore Kofi Atta-Quartey, a private citizen. He wants to stop the process to remove Chief Justice Gertrude Araba Esaaba Sackey Torkornoo.
Atta-Quartey requests an injunction on the committee of inquiry's work. He argues that the removal proceedings should pause until his case is resolved.
He filed the application on Tuesday, May 20, 2025. It also seeks to suspend the President’s Warrant of Suspension. This warrant led to the Chief Justice's temporary removal on April 22, 2025.
The application is signed by his lawyer, Ibrahim-Anyass Muhammed. It is directed against the Attorney General.
Key Reliefs Sought
Mr. Atta-Quartey seeks five major reliefs from the Supreme Court:
1. A declaration that the President’s authority must be regulated by a published constitutional instrument.
2. A declaration that the Council of State’s advisory role must follow a transparent process.
3. A declaration that inquiry proceedings must adhere to defined procedures and limitations.
4. An order nullifying all related proceedings for violating constitutional articles.
5. Any other orders necessary to protect judicial independence.
The President's suspension of the Chief Justice was announced by Felix Kwakye Ofosu, Minister for Government Communications. This action followed three petitions seeking her removal under Article 146(10) of the Constitution.
Today’s Supreme Court session may decide if removal processes continue or are paused for further judicial review.
