Kwaku Ansa-Asare, former Director of the Ghana School of Law, has spoken out about the possible suspension of Chief Justice Gertrude Torkornoo.
He believes that if a prima facie case is found, the President must act, according to Article 146 of the 1992 Constitution.
His comments follow reports that Chief Justice Torkornoo has responded to removal petitions. Sources say her response was delivered to the President and Council of State before the deadline on April 7, 2025.
In an interview with Citi FM, Mr. Ansa-Asare explained the legal process involved. He referred to Article 146(7), which states that once a committee is formed, suspension is required.
“The moment the committee is set up, the President must suspend her,” he said. He believes this approach is fair and necessary.
He also warned that allowing the Chief Justice to stay in office could harm credibility. “While inquiries are ongoing, she cannot remain in office due to potential interference,” he stated.
However, Mr. Ansa-Asare emphasized that this process should not be misused. Suspension should only happen if there are valid grounds for it.
“If a petition lacks merit, no committee should be formed,” he noted. “But if there’s merit and a prima facie case exists, then suspension is appropriate.”
