Former Director of the Ghana School of Law, Kwaku Ansa-Asare, has weighed in on the growing debate about the potential suspension of Chief Justice Gertrude Torkornoo.
He stated that if a prima facie case is established, the President has a constitutional duty to suspend the Chief Justice as outlined in Article 146 of the 1992 Constitution.
Ansa-Asare explained that once a committee is formed to investigate the allegations, the President is required to suspend the Chief Justice to avoid any interference during the inquiry. He added that continuing in her role during the process could compromise the credibility of the investigation.
However, he stressed that suspension should only occur if the petition has merit, cautioning against the abuse of the process. If the petition is frivolous, no committee should be formed, he concluded.
