Suspended Chief Justice Gertrude Torkornoo has filed a lawsuit at the Supreme Court. She aims to stop the five-member committee investigating her removal.
On Wednesday, May 21, 2025, she requested an interlocutory injunction. This would halt all proceedings of the committee. She also wants two justices removed from the panel and her suspension quashed.
The court document indicates that Torkornoo seeks an order to restrain the committee. She asks the court to suspend her warrant of suspension issued by President Mahama. This request is until a final decision is made on her case.
Her legal team at Dame and Partners filed the suit. The lawsuit follows a previous case by CenCES against Mahama’s suspension of Torkornoo. That case was dismissed by a majority decision in the Supreme Court.
Justices Paul Baffoe-Bonnie, Issifu Omoro Tanko Amadu, Yonny Kulendi, Henry Anthony Kwofie, and Yaw Asare Darko formed the panel. The ruling was decided by a 4-1 majority with Justice Darko dissenting.
CenCES argued that Mahama's decision violated constitutional provisions. However, the Supreme Court upheld his decision and allowed the committee's work to continue.
On April 22, President Mahama suspended Torkornoo after a prima facie case was determined against her by the Council of State. He then established a five-member committee to investigate petitions against her.
Weeks ago, the Supreme Court dismissed another application aimed at halting Torkornoo's removal process and revoking her suspension from office.
