Ghana Bar Association Opposes Chief Justice Suspension
The Ghana Bar Association (GBA) is opposing the suspension of Chief Justice Gertrude Araba Esaaba Sackey Torkornoo. They call the move unconstitutional and demand it be revoked immediately.
During their 2025 Mid-Year Conference on April 26, the GBA passed a strong resolution. They stated that the suspension violates key provisions of the 1992 Constitution. The GBA highlighted Article 146(10) and Article 296 as relevant to this issue.
The GBA argues that no regulations exist to guide such discretion. This makes the President’s action unlawful. “We consider the suspension to be unconstitutional,” they said in their communiqué.
They emphasized that the President cannot suspend the Chief Justice without legal guidelines. The GBA also called for immediate regulations under Article 146 for transparency in judicial matters. They requested the release of full decisions related to the case against the Chief Justice.
Additionally, they condemned politically motivated comments undermining judicial independence. The GBA reaffirmed its commitment to rule of law and judicial independence. They warned against actions that could erode public trust in the legal system.
“We will take all appropriate legal measures,” stated their resolution. Beyond this suspension, other national issues were discussed at the conference.
The GBA condemned illegal mining (galamsey) and called for urgent action against it. Regarding the Bawku conflict, they supported traditional mediation efforts and urged cooperation with peacemaking authorities like the Asantehene.
They also addressed unresolved Ablekuma North parliamentary elections. The GBA urged the Electoral Commission and security services to finalize results promptly.
The conference concluded with a call for legal professionals to shape national development actively. The GBA aims to promote justice, integrity, and democratic governance in Ghana.
