Amanda Akuokor Clinton, a legal practitioner and political analyst, spoke about Chief Justice Gertrude Torkornoo's removal process. She described it as “lawful but not just.” Her comments raised concerns about judicial independence and fairness.
Clinton shared her views on JoyNews’ *Newsfile* programme on Saturday, May 24th. She holds a Master’s degree in African Politics and leads Clinton Consultancy.
She acknowledged that the petition for the Chief Justice's removal followed constitutional provisions. However, she questioned the fairness of the process and its possible political motives. “It may be lawful, but that does not mean it is just,” she stated.
Clinton emphasized that both the legal community and the public should consider more than just the law. They must also think about the spirit behind such actions, especially for someone in a high judicial position.
“The perception of fairness is as important as legal correctness,” she explained. This perception helps protect the integrity of institutions.
She warned that even if there are legal grounds for removal, a rushed or politicized approach could harm public confidence in the judiciary.
Clinton called for transparent procedures when handling petitions against top judicial officers. This transparency is essential to maintain Ghana’s democratic institutions' sanctity.
