Thaddeus Sory, a well-known lawyer, has advised the Ghana Bar Association (GBA) to go to court. This follows President John Dramani Mahama's suspension of Chief Justice Gertrude Torkornoo.
Sory stated that the GBA should not rely on threats or outrage. The GBA had demanded that President Mahama revoke Torkornoo's suspension immediately.
The GBA claims the suspension is unconstitutional and lacks legal basis. In a statement dated April 26, they called for her reinstatement. They also requested the full decision against Chief Justice Torkornoo.
In a Facebook post, Sory explained that any recognized Chief Justice can assign cases. He noted that Torkornoo performed this duty while in office. Now, he said, the Acting Chief Justice must do the same.
Sory criticized the GBA's position, saying it implies powers are personal to Torkornoo. He pointed out that when she reassigned judges before, there were no objections from the Bar. He questioned whether they expected her to use random methods for case assignments.
He further challenged the GBA about past actions by Torkornoo that violated legal norms. Sory mentioned he publicly addressed these issues before and sees no need for threats now. If the GBA believes it has a case, he urged them to take it to court.
Sory also reflected on the GBA’s history in legal matters. He noted their past attempts have often ended in defeats. He highlighted that even outside constitutional issues, others have won against the Bar in court.
Meanwhile, Deputy Attorney General Justice Srem Sai accused the GBA of trying to bypass the constitution.
