Trans women are not legally women – UK Supreme Court rules

The United Kingdom’s Supreme Court has made a significant ruling. Transgender women with a gender recognition certificate are not legally “women.” This decision is based on the country’s Equality Act 2010.

The ruling follows a legal challenge by For Women Scotland. This campaign group questioned the Scottish government’s decision to include transgender women in laws for female representation on public boards. They argued that this could undermine women's rights, especially in leadership and single-sex spaces like shelters and bathrooms.

Lord Hodge, Deputy President of the UK Supreme Court, delivered the ruling. He stated that “woman” refers specifically to biological women under the law. Redefining it could confuse legal protections based on sex.

“We understand the strong feelings on all sides,” Lord Hodge said. He noted the need to balance advancing women’s rights with protecting transgender individuals from discrimination. While transgender individuals may not be legally categorized as “women,” their rights are still protected under other laws.

Many women’s rights advocates view this decision as a victory. However, LGBTQ+ advocacy groups express concern about potential marginalization of transgender people.
