We'll be destroying the judiciary if we go this pathway - Mike Oquaye on 'secret trial' of CJ

Former Speaker of Parliament, Professor Mike Aaron Oquaye, has raised concerns about the “secret trial” of Ghana’s Chief Justice. He warns that this could harm the integrity of the judicial system.

In an interview on JoyNews' The Pulse, Prof. Oquaye criticized the secretive nature of the proceedings. He called it a violation of human rights and due process. He emphasized that the Chief Justice deserves an open trial. “Justice must not only be done; it must be seen to be done,” he stated.

Prof. Oquaye pointed out that even low-ranking judiciary staff have appeal rights. They can appeal through various courts, from the High Court to the Supreme Court. He questioned why the Chief Justice should not have similar transparency and protections.

“Nobody wants a star chamber court or secret trials,” he argued. He noted that even traditional trials are public for community observation.

He expressed concern over a small panel conducting closed-door proceedings. This panel reportedly consists of five individuals chosen by one person. “If this is how a Chief Justice can be removed, I am not interested in the post,” he said.

Prof. Oquaye warned against isolating judges from public scrutiny during such processes. “We will destroy the judiciary if we go this pathway,” he cautioned.

He urged the Supreme Court to intervene and nullify any decisions made under this secretive process. He called for a proper, open trial that aligns with constitutional standards.

“It’s not too late to make changes,” he concluded. “We must ensure justice is done in the open for all Ghanaians.”
