We expect all actors to uphold the spirit of the law – GBA on CJ proceedings

The Ghana Bar Association (GBA) has called for a fair approach regarding Chief Justice Gertrude Araba Esaaba Sackey Torkornoo's possible removal.

On Thursday, the GBA issued a statement signed by National President Mrs. Efua Ghartey and National Secretary Kwaku Gyau Baffour. They emphasized the need for due process based on the Rule of Law.

The statement referenced Article 146 (8), (9), and (10). It noted that Committee sittings should be in camera. The President may suspend the Chief Justice with advice from the Council of State.

The GBA acknowledged that Article 146 (6) to (10) outlines the removal process. However, it stressed that all parties must act justly and fairly since the matter is sub judice.

The GBA hopes all involved will follow the Rule of Law during this process. They reminded everyone to observe Article 296 of the Constitution regarding discretionary powers.

“It is expected that even minor participants will consider Article 296,” they stated. This article addresses how discretion should be exercised to protect judicial independence.

The GBA reaffirmed its commitment to maintaining the integrity of Ghana’s justice system. “Justice comes from the people and is administered by the Judiciary,” they said.

They pledged to defend and enhance confidence in Ghana's justice delivery system. The GBA aims to be society's conscience and uphold constitutional values reflecting citizens' wishes.
