Former Special Prosecutor Martin Amidu has criticized retired Chief Justice Sophia Akuffo. He disagrees with her comments on Article 146 of Ghana’s 1992 Constitution.
Ms. Akuffo spoke to the Constitutional Review Committee (CRC) on April 30, 2025. She called the process for suspending a Chief Justice “unfair.” She suggested making the procedure more stringent.
Amidu finds her timing and context troubling. He questions her credibility since she was involved in recent constitutional processes. He noted that Ms. Akuffo advised the President before appointing a committee related to suspensions.
Her proposal includes allowing an appeal for any Chief Justice found guilty by an investigative committee. Amidu argues this contradicts her previous support for the same process she now criticizes.
He raises important questions: Why didn’t Ms. Akuffo voice these concerns earlier? Why wait until after Article 146 was activated?
Amidu's criticism focuses on Ms. Akuffo's inconsistency and its impact on constitutional stability. He believes questioning past processes undermines public trust in governance.
He states, “Such a suggestion from a former Chief Justice sends a confusing message.” Amidu suggests her comments may aim to delegitimize ongoing constitutional outcomes.
His piece encourages public reflection: Should reform debates be led by those with stakes in the system? Or does their experience enhance their calls for change?
