You took an oath, respect it – Amidu rebukes Sophia Akuffo Over CJ removal remarks

Martin Amidu has criticized retired Chief Justice Sophia Akuffo. He disagrees with her recent comments about reforming Article 146 of the 1992 Constitution. This article details how to remove a sitting Chief Justice.

In an opinion piece, Amidu questioned Akuffo's actions. He noted that she is a member of the Council of State. He argued that she should not publicly discuss constitutional matters advised by the council.

Amidu stated that once someone takes the oath for the Council of State, they must keep confidentiality. They should avoid discussing ongoing matters related to the President’s consultations.

He wrote, “A member of the Council of State has no legal, ethical, and moral authority to mount a public platform… to discuss the constitutionality of a provision.”

His remarks followed Akuffo's statements during a session organized by the Institute of Economic Affairs (IEA). She called the Article 146 process “unfair” and suggested making it stricter. She proposed allowing appeals for any Chief Justice found guilty by an investigative committee.

Amidu warned that her comments could be seen as trying to influence an ongoing investigation into removing the current Chief Justice. He described this as “an impermissible attempt at tacit bargaining.”

He also criticized some elite lawyers who think they are above scrutiny. Amidu said, “There is a breed of lawyers… who consider themselves exceptional by virtue of their professional knowledge.” He believes Akuffo’s conduct exemplifies this troubling mindset.

Finally, he argued that her public remarks could mislead people. They might think she opposed or abstained from confidential consultations on this issue, undermining its legitimacy.
